To the extent allowed by law neither T-H Marine Supplies, Inc., nor the selling distributor, nor the selling retailer shall have any responsibility for loss of use of the product or the boat, loss of time, inconvenience, commercial loss or incidental and consequential damages. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not be applicable. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not be applicable. CMC Marine will accept only parts returned for warranty prepaid from the initial purchaser and return the repaired or replaced parts freight collect. </p> <p> A return authorization number (RMA) must be issued from the factory prior to the return of defective parts. An authorization number can be requested through the internet. </p> <p> Avoid tampering with the Hydraulic Actuator if a warranty claim is to be made. The warranty is void on any hydraulic actuator returned that shows signs that it has been dismantled or electrical cord set from the motor has been cut. </p> <p> There are no warranties which extend beyond the description on the face hereof. No one has authority to make any representations concerning the operation of CMC units except those made in writing by CMC Marine, Inc. </p> <p> This warranty does not apply for any racing applications or if damage occurs because of accident, improper handing or operation, abuse or misuse. </p> <p> All liability for any incidental or consequential damage is expressly excluded from this warranty. </p> <p> In order to obtain the benefit of this warranty and agreement, the warranty card found in the centerfold of the product manual must be completely filled out and mailed within 30 days to CMC Marine, Inc. </p>

During the warranty period some staining, chalking or fading may occur. This is normal aging of the finish and is not a manufacturing defect; therefore it is not covered by this warranty.</p> <p>The Products are not warranted against cost resulting from installation of third party components, failures of third party supplied components, or failures of Hubbell provided products caused by third party provided components. This warranty is not applicable to any product(s), which are not installed and operated in accordance with the current edition of The National Electric Code (NEC), the Standards for Safety of Underwriters’ Laboratory, Inc. The terms and conditions contained in this limited warranty may not be modified, altered or waived by any action, inaction, or representations, whether oral or in writing, except upon the express, written authority of a management level employee of Attwood.</p> <p><b>This Limited Warranty does not apply to the following items:</b> <ul><li>Any Attwood products used in other applications than on pleasure boats, including but not limited to non-marine use or use on boats which are utilized for racing or commercial purposes, with the exception of the Heavy Duty Bilge Pumps installed on commercial boats (Part Numbers 4030, 4040, 4060, 4070).</li> <li>Any non water-resistant Turbo Bilge Blowers (Part Numbers 1731, and 1741) used in applications which allow direct contact with water or other liquids.</li> <li>Due to wind velocity encountered when boats are trailered, only Snug Harbor™ Silver Series, Snug Harbor™ Titanium Series, Silver Coat, Road Ready™, Road Max™, Road Max™ 600, Boaters Best™, Boaters Best™ Ultimate, and Custom boat covers, when properly tied down, are warranted as suitable for use in connection with towing on a trailer. No warranty is extended on any other boat covers when used in connection with a trailered boat.</li> <li>Damage to the boat cover or to any other property or any injury resulting from the failure to properly tie down a boat cover before towing is not covered.</li> <li>Ancillary equipment used or associated with Attwood products, including but not limited to, batteries, fuses, electric light bulbs, lamps, or sealed beam units.</li> <li>Any product damaged by accident, acts of nature, improper installation, unreasonable or improper use, lack of proper maintenance, unauthorized repairs or modifications, abuse, normal wear or tear, or other causes not arising from defects in materials or workmanship.</li> <li>Any expenses involved in the removal, reinstallation, or transportation of the product.</li> <li>Any product damaged by the failure of the owner to use, maintain, or store the product as specified in any instructions.</li> <li>Any boat cover torn or ripped because of forcing the fabric over sharp edges or corners, failing to protect the fabric from sharp objects, or allowing water, snow or ice to pool or puddle on the product.</li> <li>Any boat cover fabric discoloration, or failure due to chemical exposure such as bird droppings, tree sap, gas, and oil or mildew due to water, snow or ice, dirt, leaves, pine needles resting on the product or the product stored while damp.</li> <li>Any defect or repair requiring redesign of the Attwood product, except pursuant to the recall provisions of the United States Federal Boat Safety Act of 1971 or the recall laws of any other foreign jurisdiction.</li></ul></p>

This is a limited warranty.</li> <li>The warranty coverage commences on the original date of purchase.</li> <li>The warranty is not transferable and is voided if the cover is modified in any way by the purchaser.</li> <li>The product is eligible for either one repair or replacement within the time period of the original warranty.</li> <li>Warranties only apply to purchases made and shipped within the continental USA.</li> <li>The product must be properly installed, secured, maintained, and utilized for the purpose for which it was intended.</li> <li>During installation and removal, care must be taken not to snag the cover on sharp objects. Pad all sharp corners or sharp objects on your vehicle before covering and use care when tightening straps.</li> <li>Some Boat covers may be equipped with tie-down straps which are intended to secure the cover for safe transit. Excessive tension of tie-down straps on a cover when a boat is not in transit may cause prolonged stress on the cover. Damage caused to cover as a result of improper use of tie-down straps is not covered under the warranty.</li> <li>Avoid allowing water to pool on the cover for an extended period of time. Use a Cover Support System or other means to ensure the water can properly drain off the cover. It is not advisable to use a cover on a boat with a new interior until the vinyl has cured (at least 4 weeks). The same issue can arise from any fabric contact with vinyl including collapsed bimini tops and fabric seat cushions. Deterioration or color transfer from boat cover fabric or bimini top fabric to new marine vinyl is not covered by Eevelle warranty.</p> <p><b>Limitations:</b></p> <p>This warranty is expressly limited to the repair/replacement of the product, at the sole discretion of the manufacturer. In no event shall the seller or manufacturer be liable for any direct, indirect, punitive, incidental, or special consequential damages to property or life whatsoever arising out of or connected with the use or misuse of the products.</p>
